Signed and December 1994, in Lisbon, and in force since 1998, the Energy Charter Treaty, commonly known as ECT, constitutes one of the most important agreements for the future of the energy sector in Europe. However, the question arises: Is the ECT compatible with a decentralized energy system and free from dependence on fossil fuels?
The context in which the ECA was ratified by the various Member States in the European Union was very different from the current one and much water has flowed under the bridge since the days when the main objective was to guarantee the supply of fossil fuels from countries from the East.

Today, the reality is different, and the demand of the populations is based on the permanent abandonment of the option of fossil fuels as a fundamental step towards the decarbonization of the economy. Focused on protecting foreign investments in a given state relating to energy supply, including coal mines, oil and gas extraction, gas pipelines, refineries and thermoelectric power plants (including the famous ICSDS - dispute settlement between participating states and between investors and the state ), the TREATY is out of date with regard to environmental concerns and the preservation of the planet, reflected in the objectives of the Paris Agreement and the European Ecological Pact.
